Overview

Freshwork is on a mission to make applying for jobs better for all. We hope you love our products and services - We hope you love using the Freshwork service as much as we have loved building it.

These Terms of Service (“Terms”) describe our commitments to you, and your rights and responsibilities when using our services. Please read them carefully and reach out to us if you have any questions.

Terms of Service

These Terms govern your access to and use of Freshwork, our apps and websites including freshwork.ai and app.freshwork.ai and all subdomains and directories of these domains as well as all content and Freshwork products and services available at or though these websites (collectively, “Services”).

Our Services are offered subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Freshwork’s Privacy Policy), and procedures that may be published from time to time by Freshwork (collectively, the “Agreement”). You agree that we may automatically upgrade our Services, and the Agreement will apply to any upgrades.

Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to become bound by the Agreement. If you do not agree to all the terms of the Agreement, then you may not access or use our Services.

Section 1. Who’s Who

Throughout these Terms, “you” applies to both individuals and entities that access or use our Services. If you are an individual using our Services on behalf of an entity, you represent and warrant that you have the authority to bind that entity to the Agreement and that by using our Service(s), you are accepting the Agreement on behalf of that entity.

Your Agreement is with Kitfit Pty Ltd trading as Freshwork referred to collectively as “Freshwork” or “we” throughout these Terms.

Section 2.  Your Account

Where use of our Services requires an account, you agree to provide us with complete and accurate information when you register for an account. You will be solely responsible and liable for any activity that occurs under your username. You are responsible for keeping your account information up-to-date and for keeping your password secure.

You are responsible for maintaining the security of your account and any Service-related website, store, or other content, and you are fully responsible for all activities that occur under your account and any other actions taken in connection with our Services. You shall not share or misuse your access credentials. You must immediately notify us of any unauthorised uses of your account, store, or website, or of any other breach of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

Section 3.  Minimum Age Requirements

Our Services are not directed to children. Access to and use of our Services is only for those over the age of 13 (or 16 in the European Union). If you are younger than this, you may not register for or use our Services. Any person who registers as a user or provides their personal information to our Services represents that they are 13 years of age or older (or 16 years or older in the European Union).

Section 4. Responsibility of Visitors and Users

We have not reviewed, and cannot review, all of the content (such as, but not limited to, text, photo, video, audio, code, computer software, items for sale, or other materials) posted to our Services by users or anyone else (“Content”) and are not responsible for any use or effects of such Content. So, for example:

We do not endorse any Content or represent that Content is accurate, useful, or non-harmful. Content could be offensive, indecent, or objectionable; include technical inaccuracies, typographical mistakes, or other errors; or violate or infringe the privacy, publicity rights, intellectual property rights (see our Copyright Infringement and DMCA Policy section to submit copyright complaints), or other proprietary rights of third parties.

If you post Content, comment on a website, or otherwise make (or allow any third party to make) Content available on our Services, you are entirely responsible for the Content, and any harm resulting from, that Content or your conduct.

We disclaim any responsibility for any harm resulting from anyone’s use, purchase, or downloading of Content. If you access or use any Content, you are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content.

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

Any Content offered for sale through any of our Services are the seller’s sole responsibility, and you agree that you will look solely to the seller for any damages that result from your purchase or use of Content.

We are not a party to, and will have no responsibility or liability for, any communications, transactions, interactions, or disputes between you and the provider of any Content.

Please note that additional third party terms and conditions may apply to the downloading, copying, purchase, or use of Content.

We also have not reviewed, and cannot review, all of the material, including computer software, made available through the websites and web pages that link to, or are linked from, Freshwork or our other Services.

We do not have any control over those websites and are not responsible for their contents or their use.

The existence of a link to or from one of our Services does not represent or imply that we endorse such website.

You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content.

We disclaim any responsibility for any harm resulting from non-Freshwork websites.

Section 5. General Representation and Warranty

You represent and warrant that your use of our Services:

Will be in strict accordance with these Terms;

Will comply with all applicable laws and regulations (including, without limitation, all applicable laws regarding online conduct and acceptable content, privacy, data protection, and the transmission of technical data exported from the United States or the country in which you reside);

Will not use the Services for any unlawful purposes, to publish illegal content, or in furtherance of illegal activities;

Will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right.

Will not overburden Freshwork’s systems, as determined by us in our sole discretion;

Will not disclose sensitive personal information of others;

Will not be used to send spam or bulk unsolicited messages;

Will not interfere with, disrupt, or attack any service or network; and

Will not be used to create, distribute, or enable material that is – or that facilitates or operates in conjunction with – malware, spyware, adware, or other malicious programs or code.

Section 6. Accounts

Freshwork enables you to create profiles that help you assess your suitability for jobs and apply for jobs, and we would love for you to use it. A Freshwork account also allows you to sign into some of our Services.

Freshwork’s basic service is free, and we offer paid plans for advanced features, and access to premium content and services. Our service is designed to give you as much control and ownership over what goes on your profile as possible and encourage you to express yourself freely. You own all content you post to your profile. However, be responsible in what you publish. In particular, make sure that none of the prohibited items (like spam, viruses, or serious threats of violence) appear on your website.

If you find a Freshwork profile that you believe violates these Terms, please visit our dispute resolution and reporting page.

Your Freshwork account. If you create a profile on Freshwork and you get assigned a Freshwork-owned username, such as app.freshwork/username. You must not engage in “username squatting,” claim an unreasonable number of usernames (as determined by us), or sell access to any usernames.

License. By submitting Content to Freshwork for inclusion on your profile, you grant Freshwork a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt, and publish the Content solely for the purpose of displaying, distributing, and promoting you for Jobs. This license also allows Freshwork to make any publicly-posted Content available to third parties selected by Freshwork so that these third parties can analyze and distribute (but not publicly display) the Content through their services. You also give other Freshwork users permission to share your Content on other Freshwork profiles and add their own Content to it (aka to “reblog” your Content), so long as they use only a portion of your post and they give you credit as the original author by linking back to your profile.

Removing Content. If you delete Content, we will use reasonable efforts to remove it from public view (or in the case of a private profile, from view by the authorized visitors) on Freshwork, but you acknowledge that caching or references to the Content may not be made immediately unavailable.

Prohibited Uses. By using Freshwork, you represent and warrant that your Content and conduct do not violate the User Guidelines.

Advertisements. We reserve the right to display advertisements on your profile unless you have purchased a plan that includes the removal of ads.

Section 7. Copyright Infringement and DMCA Policy

As we ask others to respect our intellectual property rights, we respect the intellectual property rights of others. If you believe that material located on or associated with an Freshwork product or service violates your copyright, please notify us in accordance with Freshwork’s Digital Millennium Copyright Act (“DMCA”) Policy. We will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. We will terminate a visitor’s access to and use of the website if, under appropriate circumstances, the visitor is determined to be a repeat infringer of the copyrights or other intellectual property rights of Freshwork or others. In the case of such termination, we will have no obligation to provide a refund of any amounts previously paid to us.

Section 8. Intellectual Property

The Agreement does not transfer from Freshwork to you any Freshwork or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with Freshwork. The Freshwork logo, and all other trademarks, service marks, graphics, and logos used in connection with Freshwork or our Services, are trademarks or registered trademarks of Freshwork or Freshwork’s licensors. Other trademarks, service marks, graphics, and logos used in connection with our Services may be the trademarks of other third parties. Your use of our Services grants you no right or license to reproduce or otherwise use any Freshwork or third party trademarks.

Section 9. Accuracy of Account and Billing Information 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping 

. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Section 10. Changes

We are constantly updating our Services and that means sometimes we have to change the legal terms under which our Services are offered. These Terms may only be modified by a written amendment signed by an authorized executive of Freshwork, or by the posting by Freshwork of a revised version. If we make changes that are material, we will let you know by posting on one of our blogs, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect. If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective. Your continued use of our Services will be subject to the new terms. However, any dispute that arose before the changes shall be governed by the Terms (including the binding individual arbitration clause) that were in place when the dispute arose.

Section 11. Termination

We may terminate your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately. We have the right (though not the obligation) to, in our sole discretion, (i) reclaim your username due to prolonged inactivity, (ii) refuse or remove any content that, in our reasonable opinion, violates any Freshwork policy or is in any way harmful or objectionable, or (iii) terminate or deny access to and use of any of our Services to any individual or entity for any reason. We will have no obligation to provide a refund of any amounts previously paid.

If you wish to terminate the Agreement or your Freshwork account, you may simply discontinue using our Services, or, if you are using a paid service, you may cancel at any time, subject to the Fees, Payment, and Renewal section in these Terms.

All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Section 12. Disclaimer of Warranties

Our Services are provided “as is.” Freshwork and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Freshwork, nor its suppliers and licensors, makes any warranty that our Services will be error free or that access thereto will be continuous or uninterrupted. If you’re actually reading this, here’s a treat. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.

Freshwork will use its best endeavours to ensure that all information provided through any of its Services is accurate. However, Freshwork does not warrant that any information relating to products for sale through any of our Services is accurate or up to date. This information is provided by the products’ owners and/or distributors and information quality may vary. You acknowledge and agree that we will have no responsibility or liability for any inaccuracies or errors in this information.

Section 13. Jurisdiction and Applicable Law.

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of the state of NSW, Australia. 

Section 14. Limitation of Liability

In no event will Freshwork, or its suppliers or licensors, be liable with respect to any subject matter of the Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Freshwork under the Agreement during the twelve (12) month period prior to the cause of action. Freshwork shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

Section 15. Indemnification

You agree to indemnify and hold harmless Freshwork, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all losses, liabilities, demands, damages, costs, claims, and expenses, including attorneys’ fees, arising out of or related to your use of our Services, including but not limited to your violation of the Agreement, Content that you post, and any ecommerce activities conducted through your or another user’s website.

Section 16. Translation

These Terms were originally written in English (US). We may translate these terms into other languages. In the event of a conflict between a translated version of these Terms and the English version, the English version will control.

Section 17. Miscellaneous

The Agreement constitutes the entire agreement between Freshwork and you concerning the subject matter hereof. If any part of the Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of the Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof.

You may assign your rights under the Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; Freshwork may assign its rights under the Agreement without condition. The Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.

Section 18. Creative Commons Sharealike License

We’ve decided to make these Terms available under a Creative Commons Sharealike license. You’re more than welcome to copy them, adapt them, and repurpose them for your own use. Just make sure to revise the language so that your Terms reflect your actual practices. Also, if you do use these Terms, we’d appreciate a credit and link to Freshwork and Automattic (original source) somewhere on your site.

Kitfit [Pty Ltd] (ACN 624 618 355), it’s subsidiaries and affiliates in Australia (collectively referred to as Freshwork) are committed to managing personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth) and in accordance with other applicable privacy laws. 

Your privacy is critically important to us. At Freshwork, we have a few fundamental principles:

We are thoughtful about the personal information we ask you to provide and the personal information that we collect about you through the operation of our services.

We store personal information for only as long as we have a reason to keep it.

We aim to make it as simple as possible for you to control what information on your website is shared publicly (or kept private), indexed by search engines, and permanently deleted.

We aim for full transparency on how we gather, use, and share your personal information.

This document sets out our policies for managing your personal information and is referred to as our Privacy Policy.

Below we explain how we collect, use, and share information about you, along with the choices that you have with respect to that information.

Section 2. Creative Commons Sharealike License

Section 3. Information We Collect

We only collect information about you if we have a reason to do so–for example, to provide our Services, to communicate with you, or to make our Services better.

We collect information in three ways: if and when you provide information to us, automatically through operating our Services, and from outside sources. Let’s go over the information that we collect.

Section 4. Information You Provide to Us

It’s probably no surprise that we collect information that you provide to us. The amount and type of information depends on the context and how we use the information. Here are some examples:

Basic account information: We ask for basic information from you in order to set up your account. This includes things like: email address along with a username or name, depending on the way you sign up to our Service. You may provide other information you want to share but that is not required for creating an account.

Public Profile Information: We create a public profile with your username, photo, bio, information about your physical size and shape, and other profile information that you choose to share. Any information you include in your public profile will be accessible publicly unless specified otherwise. Please keep this in mind when choosing what to share.

Content Information: Depending on the Services you use, you may also provide us with information about you in draft and published content (such as your posts). For example, if you write a post that includes biographic information about you or details of the items you own, we will have that information, and so will anyone with access to the Internet if you choose to publish the post publicly.

Additional Information: Any additional personal information you provide to us, or authorise us to collect, as part of your interaction with Freshwork.

Communications with Us: You may also provide us information when you respond to surveys, communicate with our customer service team about a support question, post a question in our public forums, or sign up for a newsletter. When you communicate with us via form, email, phone, comment, or otherwise, we store a copy of our communications (including any call recordings as permitted by applicable law).

Section 5. Information We Collect Automatically

We also collect some information automatically:

Log Information: Like most online service providers, we collect information that web browsers, mobile devices, and servers typically make available, such as the browser type, IP address, unique device identifiers, language preference, referring site, the date and time of access, operating system, and mobile network information. We collect log information when you use our Services–for example, when you create or make changes to your profile on app.kit.fit.

Usage Information: We collect information about your usage of our Services. For example, we collect information about the actions that our users take on their profile or whilst posting content–in other words, who did what, when and to what thing on a site (e.g., [Freshwork username] deleted “[title of post]” at [time/date]). As another example, our Service tracks information like your email address, your career biography and other uploaded content, along other information. We also collect information about what happens when you use our Services (e.g., page views, searches, feature interactions across our Services) along with information about your device (e.g., screen size, name of cellular network, and mobile device manufacturer). We use this information to, for example, provide our Services to you, as well as get insights on how people use our Services, so we can make our Services better.

Location Information: We may determine the approximate location of your device from your IP address. We collect and use this information to, for example, calculate how many people visit our Services from certain geographic regions. We may also collect information about your precise location via our mobile apps (when, for example, you post a photograph with location information) if you allow us to do so through your mobile device operating system’s permissions.

Stored Information: We may access information stored on your mobile device via our mobile apps. We access this stored information through your device operating system’s permissions. For example, if you give us permission to access the photographs on your mobile device’s camera roll, our Services may access the photos stored on your device when you upload a really amazing photograph of a ride at sunrise to your account.

Interactions with other users: We collect some information about your interactions with other users’ profiles while you are logged in to your account with us, such as your “Likes” and the fact that you commented on a particular post so that we can, for example, recommend content we think may interest you. 

Information from Cookies & Other Technologies: A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Pixel tags (also called web beacons) are small blocks of code placed on websites and emails. Freshwork uses cookies and other technologies like pixel tags to help us identify and track visitors, usage, and access preferences for our Services, as well as track and understand email campaign effectiveness and to deliver targeted ads.

Section 6. Information We Collect from Other Sources

We may also get information about you from other sources. For example, if you create or log into your Freshwork account and connect to other services (like Linkedin and Seek), we may receive information from that service (such as your username, basic profile information, and contacts and the like) via the authorization procedures used by that service. The information we receive depends on which services you authorize and any options that are available.

We may also get information, such as a mailing address, from third party services about individuals who are not yet our users (…but we hope will be!), which we may use, for example, for marketing and advertising purposes like postcards and other mailers advertising our services.

Section 7. How and Why We Use Information

Purposes for Using Information

We use information about you as mentioned above and for the purposes listed below:

To provide our Services–for example, to set up and maintain your account, host your profile, charge you for any of our paid Services, or provide content for your browsing pleasure;

To further develop and improve our Services–for example, by adding new features that we think our users will enjoy or will help them to create and manage their websites more efficiently;

To monitor and analyze trends and better understand how users interact with our Services, which helps us improve our Services and make them easier to use;

To measure, gauge, and improve the effectiveness of our advertising, and better understand user retention and attrition — for example, we may analyze how many individuals purchased a paid plan after receiving a marketing message or the features used by those who continue to use our Services after a certain length of time;

To monitor and prevent any problems with our Services, protect the security of our Services, detect and prevent fraudulent transactions and other illegal activities, fight spam, and protect the rights and property of Freshwork and others, which may result in us declining a transaction or the use of our Services;

To communicate with you, for example through an email, about offers and promotions offered by Freshwork and others we think will be of interest to you, solicit your feedback, or keep you up to date on Freshwork and our products (which you can unsubscribe from at any time); and

To personalize your experience using our Services, provide content recommendations (for example, through our feed), target our marketing messages to groups of our users (for example, those who have a particular plan with us or have been our user for a certain length of time), and serve relevant advertisements.

Section 7. Legal Bases for Collecting and Using Information

A note here for those in the European Union about our legal grounds for processing information about you under EU data protection laws, which is that our use of your information is based on the grounds that:

(1) The use is necessary in order to fulfill our commitments to you under the applicable terms of service or other agreements with you or is necessary to administer your account — for example, in order to enable access to our website on your device or charge you for a paid plan; or

(2) The use is necessary for compliance with a legal obligation; or

(3) The use is necessary in order to protect your vital interests or those of another person; or

(4) We have a legitimate interest in using your information — for example, to provide and update our Services; to improve our Services so that we can offer you an even better user experience; to safeguard our Services; to communicate with you; to measure, gauge, and improve the effectiveness of our advertising; and to understand our user retention and attrition; to monitor and prevent any problems with our Services; and to personalize your experience; or

(5) You have given us your consent — for example before we place certain cookies on your device and access and analyze them later on.

Section 8. Sharing Information

How We Share Information

We do not sell our users’ private personal information.

We share information about you in the limited circumstances spelled out below and with appropriate safeguards on your privacy:

Subsidiaries, Employees, and Independent Contractors: We may disclose information about you to our subsidiaries, our employees, and individuals who are our independent contractors that need to know the information in order to help us provide our Services or to process the information on our behalf. We require our subsidiaries, employees, and independent contractors to follow this Privacy Policy for personal information that we share with them.

Third Party Vendors: We may share information about you with third party vendors who need to know information about you in order to provide their services to us, or to provide their services to you or your site. This group includes vendors that help us provide our Services to you (like payment providers that process your credit and debit card information, payment providers you use for your ecommerce operations, fraud prevention services that allow us to analyze fraudulent payment transactions, postal and email delivery services that help us stay in touch with you, customer chat and email support services that help us communicate with you, those that assist us with our marketing efforts (e.g. by providing tools for identifying a specific marketing target group or improving our marketing campaigns), those that help us understand and enhance our Services (like analytics providers), and companies that make products available on our websites, who may need information about you in order to, for example, provide technical or other support services to you. We require vendors to agree to privacy commitments in order to share information with them. 

Legal and Regulatory Requirements: We may disclose information about you in response to a subpoena, court order, or other governmental request. 

To Protect Rights, Property, and Others: We may disclose information about you when we believe in good faith that disclosure is reasonably necessary to protect the property or rights of Freshwork, third parties, or the public at large. For example, if we have a good faith belief that there is an imminent danger of death or serious physical injury, we may disclose information related to the emergency services without delay.

Business Transfers: In connection with any merger, sale of company assets, or acquisition of all or a portion of our business by another company, or in the unlikely event that Freshwork goes out of business or enters bankruptcy, user information would likely be one of the assets that is transferred or acquired by a third party. If any of these events were to happen, this Privacy Policy would continue to apply to your information and the party receiving your information may continue to use your information, but only consistent with this Privacy Policy.

With Your Consent: We may share and disclose information with your consent or at your direction. For example, we may share your information with third parties with which you authorize us to do so, such as the social media services that you connect to your site.

Aggregated or De-Identified Information: We may share information that has been aggregated or reasonably de-identified, so that the information could not reasonably be used to identify you. For instance, we may publish aggregate statistics about the use of our Services and we may share a hashed version of your email address to facilitate customized ad campaigns on other platforms.

Section 9. Information Shared Publicly

Information that you choose to make public is–you guessed it–disclosed publicly.

That means, of course, that information like your public profile, posts, other content that you make public on your profile, and your “Likes” and comments on other profiles, are all available to others–and we hope you get a lot of engagement!

For example, the photo that you upload to your public profile, or a default image if you haven’t uploaded one, along with other public profile information, may display with the comments and “Likes” that you make on other users’ websites while logged in to your Freshwork account. Your photo + public profile information may also display with your comments, “Likes,” and other interactions on our Service.

Public information may also be indexed by search engines or used by third parties.

Please keep all of this in mind when deciding what you would like to share.

Section 10. How Long We Keep Information

We generally discard information about you when we no longer need the information for the purposes for which we collect and use it — which are described in the section above on How and Why We Use Information — and we are not legally required to continue to keep it.

For example, we keep the web server logs that record information about a visitor to one of Freshwork’s websites, such as the visitor’s IP address, browser type, and operating system, for approximately 30 days. We retain the logs for this period of time in order to, among other things, analyze traffic to Freshwork’s websites and investigate issues if something goes wrong on one of our websites.

As another example, when you delete a post, page, or comment from your Freshwork account, the deleted content may remain on our backups and caches until purged.

Section 11. Security

While no online service is 100% secure, we work very hard to protect information about you against unauthorized access, use, alteration, or destruction, and take reasonable measures to do so, such as monitoring our Services for potential vulnerabilities and attacks.

Section 12. Choices

You have several choices available when it comes to information about you:

Limit the Information that You Provide: If you have an account with us, you can choose not to provide the optional account information, profile information, and transaction and billing information. Please keep in mind that if you do not provide this information, certain features of our Services — for example, paid, premium themes–may not be accessible.

Limit Access to Information on Your Mobile Device: Your mobile device operating system should provide you with the ability to discontinue our ability to collect stored information or location information via our mobile apps. If you do so, you may not be able to use certain features (like adding a location to a photograph, for example).

Opt-Out of Marketing Communications: You may opt out of receiving promotional communications from us. Just follow the instructions in those communications or let us know. If you opt out of promotional communications, we may still send you other communications, like those about your account and legal notices.

Set Your Browser to Reject Cookies: At this time, Freshwork does not respond to “do not track” signals across all of our Services. However, you can usually choose to set your browser to remove or reject browser cookies before using KFreshwork’s websites, with the drawback that certain features of Freshwork’s websites may not function properly without the aid of cookies.

Close Your Account: While we’d be very sad to see you go, if you no longer want to use our Services :( :( :( :(, you can close your account. Please keep in mind that we may continue to retain your information after closing your account, as described in How Long We Keep Information above — for example, when that information is reasonably needed to comply with (or demonstrate our compliance with) legal obligations such as law enforcement requests, or reasonably needed for our legitimate business interests.
